LIABILITY WAIVER FORM
Please read this form, you will be required to sign and date that you have read and understand upon arrival at the Tour Base prior to departure.
I understand and acknowledge that there are both foreseeable and unforeseeable risks associated with participating in the tour to Chantry Island, and that no amount of care, caution, or expertise can eliminate these risks. These risks may include, but are not limited to, serious bodily injury, permanent disability, and loss of life.
I am aware that the activities involved in the tour, including but not limited to:
Climbing the steep, narrow staircase of 107 steps to the light room in the tower (a structure built in 1858 not designed for public access)
Navigating uneven pathways
Boarding and disembarking the Tour Boat from floating docks may be hazardous, and I could suffer serious injury.
I understand that:
There is no access to the outdoor balcony at the top of the tower.
Only the immediate grounds around the Tower and Keeper’s House are accessible.
Due to the status of the site as a Protected Migratory Bird Sanctuary, all other areas are restricted.
I am voluntarily participating in these activities with full knowledge of the risks involved.
I agree to assume any and all risks of bodily injury or property damage while participating in the tour.
I agree to indemnify and save His Majesty the King in Right of Canada, the Minister of Fisheries and Oceans Canada, their employees or agents, the Town of Saugeen Shores, and the Marine Heritage Society harmless from any and all damages, losses, costs, expenses, liabilities, claims, demands, or actions that I or any third party may suffer or incur as a result of my participation in the tour to Chantry Island.
I confirm that I have read and fully understand this release prior to signing it, and I agree that this release and indemnity shall be binding upon my heirs, next of kin, executors, administrators, and personal representatives.
I will comply with the instructions of the boat captain and crew and the guides on the Island. The boat is equipped with life preservers in case of the need to abandon ship. The island has difficult and slippery footing so care must be exercised to avoid falling. The lighthouse has 107 steps and persons with any medical conditions or risks climbing those steps or falling or any other reason may decline to take the lighthouse part of the tour. I will supervise careful any children under my care on the boat and on the Island. At any time up to the departure of the boat from the dock, I may opt out of the tour because of safety concerns and receive a full refund.
I accept the risks of taking the boat tour to Chantry Island. Form: 26 April 25
